Thank you for using Abett’s mobile application and or website, which are owned, controlled and provided by Abett, Inc., a Washington corporation. The following terms govern use of services and products provided by Abett.

Users and User Accounts

Individuals must be 13 years or older to use Abett’s services. If you create an account, you are responsible for the security and secrecy of your password, and any activity that occurs through your account.

Abett owns all rights, titles, and interest in our services. We grant users a non-exclusive, non- transferable, non-sublicensable, revocable limited license to use them. We reserve the right to refuse access to our services to anyone or any entity for any reason at any time. Your sole remedy for dissatisfaction with our services is to stop using them.

You cannot use our service for any use that is for illegal, damaging to other’s rights, for the purpose of building a competitive product or service, or otherwise in violation of these terms. You may not post descriptions or images of nudity or graphic violence. You may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify or create derivative works of services.

Fees and Charges

You agree to pay Abett any fees for Services you purchase from Abett in accordance with the pricing and payment terms presented to you for that particular Service.

You are responsible for payment of any costs or expenses incurred as a result of downloading and using Abett’s services, including from any operator network, mobile carrier, or roaming charges.

Copyright, and Third-Party Applications and Content

All content on Abett’s mobile application and website is the property of Abett and protected by United States and international copyright laws.

Our services may provide links to content from other websites, applications or services that are not owned or controlled by Abett (“Third Party Services”). Third Party Services are provided only as a convenience, and Abett is not responsible or liable for anything related to their content, security or their privacy practices. Third Party Services are subject to the terms and conditions of the relevant third party provider

Disclaimers, Governing Law and Venue

Our services are provided “as is,” “as available,” “with all faults,” and without warranties.

These terms shall be governed by and construed in accordance with the laws of the State of Washington. Venue for any dispute shall be in any state or federal court in King County, Washington.

Limitation of Liability

To the maximum extent permitted by law, Abett shall not be liable for any direct, indirect, incidental, consequential, special, punitive, exemplary, or other damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, good-will, or other intangible losses, related to (a) Abett’s Services; (b) your access to, use of, or inability to access or use Abett’s Services; and (c) any conduct or content of other users or Third Party Services, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties.

Severability

In case any one or more of the provisions contained in these terms shall for any reason be held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision of the terms.
